I am very excited (or at least cautiously optimistic) to be writing of a positive development in the battle to save Red Rock.  This Tuesday, January 22, 2013, the Clark County Commissioners are going to vote whether or not to:

  • "sign a resolution supporting efforts to exchange the Gypsum Mine Property on Blue Diamond Hill for federal land." full resolution

This today from the Las Vegas Review Journal:

  • "Developer Jim Rhodes' plan to build a 2,000-acre neighborhood overlooking the Red Rock Canyon National Conservation Area could soon be no more.
  • Clark County Commissioner Susan Brager is spearheading an effort to encourage the federal government to allow Rhodes to swap his land with a different, less controversial, piece of federal property...." full article

STATE SUPREME COURT CASE

Tuesday, Oct. 3, the Nevada Supreme Court heard the appeal in the Gypsum Resources V. Masto case that could be the solution to this entire atrocity of trying to put nonconforming high density development in the precious rural area of Red Rock Canyon.  Save Red Rock was there to hear the proceedings.

 
The choice before the judges:
Was the law (SB 358) made by the people to protect Red Rock, unconstitutional because it did not apply to every county in the state, and/or it singled out one person?  Or is the "value" of Red Rock unique and compelling and broad enough to warrant "deference" and protection?

Just When the Law Was on Our Side

Jim Rhodes is at it again! They (Clark County Commission) said he couldn't use construction trucks so he's just started burning up the scenic byway with construction trucks. They said he couldn't move forward with his plan without BLM access, so he's just started moving forward with his plan without BLM access! They said he couldn't use the mine road that was eliminated, so he's just started using the mine road that was eliminated!

 

Here's something very disturbing I heard today and I posted it on our ABOUT page: Compared to the 45,000 number that the developer estimated, current usage is only:

Victory for Red Rock!

Great news everyone!  Red Rock's in the clear!  No need to go to Feb. 8 meeting!

Thanks to YOUR public involvement and a supportive county commission, the developer has withdrawn his application for BOTH WAIVERS for Red Rock!  There will not be a vote on February 8, 2012.  This could not have happened without so much public support. Thanks to the Save Red Rock Coalition members, the LV Astronomical Society, THE KILLERS Rock Band, the Nevada Conservation League, the cyclists and runners, the homeowners groups, the Tour Companies, the photographers, and the thousands of concerned citizens in Las Vegas and beyond for voicing your concerns.

 

Thank You Chairwoman Brager and Supportive Commissioners for hearing your constituents and caring about the canyon. Since day one of the waivers request, Commission Chairwoman, Susan Brager said that she would not waive these two conditions of protection for Red Rock that she created and hosted a public meeting at which she reiterated her resolve. We believe it was this open and public commitment that set the tone for this latest battle and is directly responsible for the win today, along with the historic support of Commissioners Chris Giunchiliani and Lawrence Weekly, and indications of support by other commissioners. We are grateful that the scenic byway is no longer being proposed as a construction traffic route and that public BLM process is not being circumvented. We are very excited about this and will support our commissioners in any effort to help SAVE RED ROCK CANYON!

 

Thank you Rick Colville and Max Heeman for doing exhaustive research on the waivers, the development, and the land use laws.  Jim Rhodes may have good lawyers, but there's no wool being pulled over anyone's eyes here.  We just want him to have to do what any other property owner would have to do, and not circumvent the law.  Rick and Max know the law so it won't be that easy for him anymore.  If anyone needs any facts at all, thanks to them, we have reasearch the size of the Library of Congress at our disposal!

 

Thank you Justin Jones and Matt Callister and the pro bono services of Holland and Hart and Callister Law for interpreting and applying the law, and for keeping the coalition in line and progressively marching towards protection of Red Rock Canyon. With this calibur legal guidance and the help of more and more interested parties, the coalition is strengthening daily.

Thanks to everyone who participated in the super successful Red Rock Rally!  The canyon received overwhelming support that day, both at LIFETIME Fitness and throughout the canyon as runners and riders rode for Red Rock on the scenic byway in question.  This Wednesday's vote is what it's all about.  You can go to the meeting at the county building or you can email your vote (click below).  Attendance was high and supportive at both the rally and community input meeting in which Commission Chair, Susan Brager, committed to denying both waivers, but we still need a majority vote among commissioners, so you can come to the meeting on Wednesday or do the QUICK ONE CLICK method:

On February 8, 2012, seven county commissioners will decide the fate of the Red Rock Canyon Scenic Byway. Will it become the next construction traffic highway for Southern Nevada?  Will the mess and debris of commercial construction trucks penetrate our sacred canyon, and clog it up with debris, noise, dust, and pollution?  *And for the second waiver, will commissioners grant this developer a special favor by helping him with his BLM processes to expedite the process and save him millions in land use fees and rents?

Photo from the last time Red Rock was used as a construction traffic highway, when Mountain's Edge was being developed in 2004.  A construction truck hauling cement to/from the development went down near the scenic overlook.  A time of relentless noise and congestion.

 

The good news is, several of the commissioners are against waiving these two protections for Red Rock.  Commissioner Brager created the conditions and stands behind them.  But the developer's lawyers are still at it.  Rhodes' lawyer Chris Kempfer agreed to these conditions at the last hearing so he could get the votes he wanted, and now he is asking Commissioners to waive them!  Commissioner Brager said she knows that these two conditions she added to protect Red Rock were fair.  She held a public comment meeting for everyone to voice their concerns.  Hundreds of concerned citizens attended that meeting and hundreds more came to the Rally to Save Red Rock.  Susan Brager said that although anyone is welcome to come to the county commission meeting, her position is firm, so not to worry.  They would rather not sit through another 6 hours of passionate testimony because they already know how everyone feels.  They'll just try to keep the meeting short.  If you can't make it to the meeting, Emails are another way to voice your opinion. We hope most of the Commissioners will stand up for Red Rock this time and vote no on both waivers.  To those commissioners, we say, thank you! and to the rest, we ask to, VOTE NO ON BOTH WAIVERS!
